tuzione dei Prodotti ovvero una riduzione del prezzo. 7.7 I colori dei Prodotti presenti
nel catalogo cartaceo o nei documenti pubblicati sul sito web di Donà Salotti s.r.l. sono
meramente indicativi. Per le strutture e le parti laccate dei Prodotti il riferimento croma-
tico sarà dato dalla scala RAL indicata nel listino. 7.8 I colori dei tessuti e delle pelli
presenti nei campionari, tirelle o altri supporti sono meramente indicativi. In nessun
caso, pertanto, eventuali campioni di Prodotto esaminati dal Cliente potranno essere
considerati quale termine di paragone esclusivo per l’aspetto esteriore dei Prodotti.
Eventuali differenze cromatiche dei Prodotti consegnati, rispetto alle caratteristiche dei
relativi campioni esaminati dal Cliente, non conferiranno a quest’ultimo il diritto di risol-
vere il Contratto e/o di chiedere la sostituzione degli stessi ovvero una riduzione del
prezzo. 7.9 I colori dei tessuti e delle pelli possono variare di tonalità da una partita
all’altra. In nessun caso le differenze di colori dei tessuti e delle pelli di Prodotti dello
stesso tipo, consegnati con partite e/o in momenti diversi, potranno essere qualificate
come vizi e/o difetti dei Prodotti, né daranno titolo al Cliente per pretendere la sostitu-
zione e/o la riduzione del relativo prezzo. 7.10 In nessun caso la responsabilità com-
plessiva di Donà Salotti s.r.l. per danni derivanti da vizi e/o difetti dei Prodotti in forza di
un Contratto potrà eccedere il loro prezzo complessivo. 8. TESSUTI CLIENTE In
caso il Cliente intenda fornire il tessuto per confezionare i Prodotti, le seguenti condi-
zioni andranno tenute in considerazione e/o rispettate: (i) Le misure dei metraggi di
tessuto occorrenti per la confezione, segnati a lato di ogni elemento, sono considerati
per un’altezza di cm 140 e sono riferiti a tessuti uniti o con disegni senza rapporto; nel
caso di invio di tessuti a righe o a disegni con rapporto, il consumo di tessuto sarà
maggiore del 10% (integrazione minima non inferiore ai 50 cm) e sarà applicato una
maggiorazione del 7% rispetto al prezzo indicato nella categoria tessuto cliente; (ii) Il
tessuto andrà fornito Reso al luogo di destinazione (DAP – Incoterms 2020) presso la
sede di Donà Salotti s.r.l.; (iii) Il “prezzo tessuto cliente” indicato nel listino riguarda solo
la lavorazione dei tessuti forniti dal Cliente o dai suoi fornitori; in caso il Cliente fornisca
pelli, il prezzo applicabile sarà quello della categoria “CLIENTE” e sarà applicato una
maggiorazione del 15%; (iv) Qualora il Cliente invii tessuti tramite i propri fornitori,
quest’ultimi dovranno intestare i documenti di trasporto a Donà Salotti s.r.l. e specifica-
re nella parte delle annotazioni la seguente dicitura: “Merce consegnata per ordine e
conto della società ________ alla quale sarà fatturata”; (v) Il servizio di prelavaggio
non è fornito per i tessuti forniti dal Cliente; (vi) Donà Salotti s.r.l. si riserva il diritto di
non utilizzare tessuti o pelli cliente con caratteristiche giudicate non idonee alla confe-
zione dei propri prodotti; (vii) E’ espressamente esclusa la garanzia sui tessuti o sulle
pelli forniti dal o per conto del Cliente. 9. FORO COMPETENTE Per qualsiasi
controversia relativa alle presenti Condizioni Generali, a un qualsiasi Contratto e/o alla
fornitura di Prodotti sarà competente in via esclusiva il Tribunale di Vicenza, Italia. 10.
LEGGE APPLICABILE Le presenti Condizioni Generali di vendita saranno disci-
plinate dal diritto italiano, con espressa esclusione delle sue norme di diritto internazio-
nale privato in tema di rinvio ad altri ordinamenti. Qualora il Cliente sia un soggetto di
diritto straniero o comunque un soggetto avente la propria sede legale o il principale
stabilimento all’estero, i Contratti relativi alla fornitura dei Prodotti saranno in ogni caso
regolati dalla Convenzione delle Nazioni Unite sui Contratti di Vendita Internazionale di
beni mobili (Convenzione di Vienna, 11 aprile 1980). 11. RINUNCE La circostanza
che Donà Salotti s.r.l. non faccia valere uno qualsiasi dei diritti di cui alle presenti
Condizioni Generali, non potrà essere intesa come implicita rinuncia a tali diritti, né
impedirà a Donà Salotti s.r.l. di pretenderne la puntuale e rigorosa osservanza in altro
momento. 12. LINGUA Le presenti condizioni generali sono redatte in italiano ed in
inglese, restando inteso che in caso di contrasto e/o divergenza fra le versioni, prevar-
rà sempre il testo in lingua italiana.
D.Home Italia turns out to be a commercial brand of the company Donà Salotti s.r.l.
1. GENERAL TERMS OF SALE 1.1 These General Conditions shall supersede
and prevail over Donà Salotti s.r.l.’s earlier versions of the same. 1.2 Donà Salotti s.r.l.
shall be entitled to modify the design and technical specification of the Products includ-
ed in the catalogue, when such modifications are needed for technical reasons and
provided that such modifications do not alter the quality of the Products 2. TERMS
OF DELIVERY OF PRODUCTS 2.1 The terms of delivery of the Products (i) are
specified in Donà Salotti s.r.l.’s order confirmation, (ii) are approximate and roughly set
forth and (iii) in no case shall they be construed as of essence. 2.2 In case of delay in
the delivery of the Products, caused by a fortuitous event, force majeure or other caus-
es not depending on Donà Salotti s.r.l.’s willful misconduct and/or gross negligence, the
Client shall not be entitled to claim any compensation for damages, nor to ask for the
termination of the Agreement and/or for the reduction of the price of the Products. 2.3
The delivery of goods can be postponed on Client’s request for a maximum of 15 days
compared to the expected collection date; after this deadline Donà Salotti s.r.l. will ap-
ply storage costs of € 0.30/m³ per day and € 8.50/m³ for packages movement. 3.
TRANSPORT Prices include transportation to the customer’s location, provided it is
within Italian territory. Goods travel at the customer’s risk, even for free deliveries. Or-
ders with delivery to private client are not accepted, and any porterage costs are borne
by the customer. 4. ORDERS 4.1 The purchase orders shall be made in writing and
completed with all the data required for the identification of the Products, their features
and quantities. 4.2 Right or left hand side of a Product are set facing the Product. 4.3
Upon written notice to the Client, Donà Salotti s.r.l. will be entitled to replace the fabrics
and the leathers ordered by the Client with fabrics and leather having the same or
similar features, in case suppliers of such articles remove them from their catalogue.
The Client shall not be entitled to terminate the relevant Agreement, should Donà Sa-
lotti s.r.l. comply with the obligations set forth by this clause. In no case Donà Salotti
s.r.l. may be required to supply white structures without lining. 4.4 Any delay of the
Client in the transmission of information, data, measures, quantities and/or technical
specifications of the Products subject matter of any Agreement may cause a propor-
tional postponement of the delivery terms, to be newly determined by Donà Salotti s.r.l..
5. PRICES AND PAYMENTS 5.1 The prices of the Products indicated in the
Price-list are expressed in Euro, are merely indicative and can be modified at any time
by Donà Salotti s.r.l.. The actual price of the Products is specified in Donà Salotti s.r.l.’s
order confirmation and the same shall not include VAT. Any changes / modifications
and/or replacements of the Products, agreed by the parties after the transmission of
Donà Salotti s.r.l.’s order confirmation, may cause the adjustment of the relevant price
due on account of any increase of the costs of production and/or of the raw materials
or of the works / replacements that may be required. 5.2 The price of the Products shall
be paid by the Client as per the terms and ways specified in Donà Salotti s.r.l.’s order
confirmation, or otherwise agreed by the parties. 5.3 If the Customer requests ship-
ments of Products with an amount less than Euro 550.00 (net of VAT and any dis-
counts), the relevant packaging and shipping costs will be charged with a minimum
amount of Euro 45.00.5.4 Where practicable, upon written request of the Client, Donà
Salotti s.r.l. may carry out a pre-wash treatment in water of fabrics at the cost of Euro
15,00 per linear meter. The Client is aware that the pre-wash treatment makes covers
more flexible and soft and that the fibers may fade a little. 5.5 Donà Salotti s.r.l. shall be
entitled to suspend the delivery of the Products should: (a) the Client’s assets and/or
financial standings jeopardize the relevant payment; (b) the Client fails to timely pay

Products previously supplied by Donà Salotti s.r.l., also on the basis of other Agree-
ments, until full payment of the outstanding credit and/or until receipt of proper guaran-
tees of the Client for any delivery in progress, without prejudice to Donà Salotti s.r.l.’s
right to claim for any damages suffered as a consequence thereof. 5.6 In no event shall
any vice and/or defect of the Products, even when expressly acknowledged as such by
Donà Salotti s.r.l., and/or any delay of delivery as to the agreed terms give the Client
the right to suspend the relevant payments and/or any other payment for whichever
reason due to Donà Salotti s.r.l. also under other contractual relationships. 5.7 In case
of late payments, Donà Salotti s.r.l. shall be entitled to charge interests on the unpaid
amount at the rate provided by the law. 6. RETENTION OF TITLE Donà Salotti
s.r.l. shall be the sole owner of the Products until the date of their full payment. Should
the Agreement be terminated due to the Client’s breach of contract, Donà Salotti s.r.l.
shall be allowed to withhold any advance payment of the latter as an indemnity within
the limits set forth by the law, without prejudice to the latter’s right to claim for further
damages and to collect the Product charging the relevant costs of collection to the
Client. 7. WARRANTLY 7.1 Donà Salotti s.r.l. guarantees that the Products comply
with the quality standards set forth by the Italian law and the applicable EU regulations
and will be free from defects in material and workmanship for 24 months as of the de-
livery of the Products (“Warranty Period”). 7.2 Should the complaints raised by the
Client within the Warranty Period with reference to the Products be grounded and ac-
cepted by Donà Salotti s.r.l., the latter shall repair the defective part of the Product, with
delivery Ex Works (EXW - Incoterms 2020). The warranty obligations herewith under-
taken shall be effective and binding only provided that Donà Salotti s.r.l. has the oppor-
tunity to verify the vices and/or defects raised by the Client. Donà Salotti s.r.l.’s warran-
ty obligation shall be deemed as entirely fulfilled with the repair of the defect claimed by
the Client, without any further obligations. 7.3 Subject to forfeiture of warranty, the
Client shall notify in writing, by return receipt registered letter, any defect(s) found in
any delivered Product within and not later than 8 (eight) days as of the date of the ac-
tual delivery or, in case of hidden defects, within and not later than 8 (eight) days as of
the date of the relevant discovery. 7.4 The warranty is expressly excluded for defects
of the Products arising from and/or caused by the following causes:(i) deposit and/or
storage of Products not in compliance with Donà Salotti s.r.l.’s instructions; (ii) failure to
comply with the rules and instruction specified on the back of each sample and on the
warranty certificate provided (e.g. washing and maintenance of the covers not in com-
pliance with Donà Salotti s.r.l.’s instruction, etc.); (iii) alteration and/or modification of
the Products not authorized in writing by Donà Salotti s.r.l. (e.g. dismantling of fillings,
foam and feather, re-sewing of cushions, etc.); (iv) normal wear and tear of the Prod-
ucts; (v) wrong assembly of the Products; (vi) fabric or leather supplied by the Client or
by its suppliers on behalf of the Client; (vii) any other event for which Donà Salotti s.r.l.
is not directly liable. The Client shall be subject to forfeiture of the warranty should the
same fail to timely pay the agreed price, even if such a default or delay concerns only
a portion of the Products aggregate price. 7.5 Without prejudice to the compulsory
product’s liability law and any liability for wilful misconduct and/or gross negligence,
Donà Salotti s.r.l. shall not be liable for direct, indirect or incidental damages caused to
the Client and/or to third parties as a consequence of the defects of the Products. The
Client shall not be entitled to terminate the relevant Agreement for defects of Products
subject to this warranty, should Donà Salotti s.r.l. timely comply with the obligations of
this warranty. 7.6 Due to the technical features of upholstered products, the Products
may have dimension of +/- 2 cm with respect to the dimension indicated in the cata-
logue or Price-list. Any difference in dimensions within he above indicated tolerance
shall not entitle the Client to terminate the Agreement and/or request the replacement
of the Products or the reduction of price. 7.7 The colours of the Products shown in
Donà Salotti s.r.l.’s paper catalogue or in the documents published in Donà Salotti
s.r.l.’s website shall be deemed as merely indicative. For the Product’s lacquered struc-
ture the RAL codes indicated in the Price List shall be taken as reference. 7.8 The
colors of the fabrics and of the leather of the samples or of other sales tools shall be
deemed as merely indicative. In no case shall therefore any Product sample examined
by the Client be qualified as the exclusive reference for the exterior appearance of the
Products. Any chromatic difference of the delivered Products compared to the charac-
teristics of the relevant samples examined by the Client, shall not entitle the latter to
terminate the Agreement and/or to ask for the replacement of the Products or for the
reduction of the price. 7.9 The colours of the fabrics or of the leather can change tonal-
ity in different lots. In no event shall the chromatic differences between Products of the
same type, delivered with different lots and/or in different moments, be qualified as
vices and/or defects of the Products, nor shall the Client be entitled to claim their re-
placement and/or the reduction of the relevant price as a consequence thereof. 7.10 In
no case shall the aggregate Donà Salotti s.r.l.’s liability for damages arising out of vices
and defects of the Products pursuant to an Agreement exceed their aggregate price. 8.
CLIENT’S FABRICS Should the Client require to provide the fabrics for the man-
ufacture of the Products, the following conditions shall be kept into consideration and
complied with. The measure of lengths in meters of fabrics required for a width of cm
140 are referred to plain fabric or with patterns without repeat; in case of delivery of
striped fabric or with patterns with repeat a higher consumption of 10% (minimum ad-
dition of 50 cm) and an extra charge of 7% referred to the category of Customer’s
fabric must be considered; (ii) The fabric shall be delivered Delivery at place (DAP –
Incoterms 2020) at Donà Salotti s.r.l.’s premises; (iii) The “Client’s fabric price” indicat-
ed in the Price-list refers to the manufacture of fabrics provided by the Client or its
suppliers only; in case the Client provides Donà Salotti s.r.l. with its leather, then the
applicable price will be the one listed in the “CUSTOM” category with an extra charge
of 15%; (iv) Should the Client send fabrics through other suppliers, the latter shall indi-
cate in the transportation document Donà Salotti s.r.l. as consignee and specify in the
notes that “the goods are delivered on behalf of the company _________, to which it
will be invoiced”; (v) the pre-wash service is not available for the Client’s fabrics; (vi)
Donà Salotti s.r.l. may reserve the right to refuse customer’s fabrics or leathers with
characteristics not suitable for their products;(vii) fabrics or leather provided by the
Client or on behalf of the Client is not covered and is expressly excluded from Donà
Salotti s.r.l.’s warranty. 9. EXLUSIVE COURT All disputes arising out of or relating
to these General Conditions, any Agreement and/or to the supply of Products shall be
exclusively submitted to and settled by the Court of Vicenza, Italy. Donà Salotti s.r.l.
shall in any case be entitled, at its exclusive discretion, to institute legal proceedings
against the Client before the Court of the place where the Client has its registered of-
fice. 10. APPLICABLE LAW These General Conditions of sale shall be governed
by Italian Law with the express exclusion of the applicability of its international private
law conflict of laws provisions. Should the Client be a foreign entity or in any case an
entity having its registered office or its main place of business abroad, the Agreements
related to the supply of the Products shall in any case be regulated by the United Na-
tions Convention on the International Sale of Goods (Wien Convention, April 11,
1980).11. WAIVER Failure by Saba Italia to enforce at any time the provisions of
these General Conditions shall not be construed as a waiver of such provision or of the
right to thereafter enforce each and every provision herein. 12. LANGUAGE These
General Conditions are drafted in Italian, English, French and Spanish, it being agreed
that should any conflict or inconsistency arise among the versions, the Italian wording
shall prevail.
D.Home Italia risulta essere un brand commerciale della società Donà Salotti s.r.l.
1. CONDIZIONI GENERALI DI VENDITA 1.1 Le presenti Condizioni Genera-
li sostituiscono e rendono inefficaci eventuali condizioni generali di Donà Salotti s.r.l.
precedentemente in vigore. 1.2 Donà Salotti s.r.l. si riserva la facoltà di modificare i
Prodotti presenti nel catalogo quando tali modifiche sono necessarie e/o opportune per
esigente tecniche o di produzione e nella misura in cui non comportino riduzione nella
qualità del Prodotto. 2. TERMINI DI CONSEGNA DEI PRODOTTI 2.1 I ter-
mini di consegna dei Prodotti (i) sono precisati nella conferma d’ordine di Donà Salotti
s.r.l., (ii) hanno carattere indicativo e (iii) non sono qualificabili come termini essenziali.
2.2 In caso di ritardi nella consegna dei Prodotti, causati da caso fortuito, forza maggio-
re o da altri eventi non imputabili a dolo e/o colpa grave di Donà Salotti s.r.l., il Cliente
non potrà pretendere alcun risarcimento del danno né chiedere la risoluzione del Con-
tratto e/o la riduzione del prezzo dei Prodotti. 2.3 La consegna dei prodotti potrà esse-
re rinviata su richiesta del Cliente per un massimo di 15gg rispetto alla data di ritiro
previsto; trascorso tale termine Donà Salotti s.r.l. addebiterà costi di stoccaggio di €
0,30 m³ al giorno e € 8,50 m³ per movimentazione colli. 3. TRASPORTO I prezzi
includono il trasporto presso la sede del cliente, purchè in territorio italiano. La merce
viaggia a rischio del committente anche per consegne franco destino. Non si accettano
ordini con consegna a privato e le eventuali spese di facchinaggio sono a carico del
cliente 4. ORDINI 4.1 Gli ordini d’acquisto devono essere trasmessi per iscritto, com-
pleti di tutti i dati necessari per l’individuazione dei Prodotti, delle loro caratteristiche e
delle quantità. 4.2 La definizione di un particolare destro / sinistro di un prodotto è
sempre da intendersi vista frontale. 4.3 Previa comunicazione scritta al Cliente, Donà
Salotti s.r.l. si riserva la facoltà di sostituire i tessuti e le pelli ordinate dal Cliente con
tessuti e pelli aventi caratteristiche analoghe e/o simili, nel caso i fornitori di tali articoli
li abbiano eliminati dal proprio catalogo. Il Cliente non avrà titolo per risolvere il Con-
tratto, in caso Donà Salotti s.r.l. fornisca i Prodotti nel rispetto delle obbligazioni previ-
ste dalla presente clausola. In nessun caso Donà Salotti s.r.l. potrà fornire strutture in
bianco senza rivestimento. 4.4 Ogni eventuale ritardo del Cliente nella trasmissione di
informazioni, dati, misure, quantità e/o specifiche tecniche dei Prodotti oggetto di un
Contratto, potrà determinare un proporzionale differimento dei termini di consegna, che
saranno nuovamente stabiliti da Donà Salotti s.r.l.. 5. PREZZI E PAGAMENTI 5.1
I prezzi indicati nel Listino sono espressi in Euro, sono indicativi e potranno essere
modificati da Donà Salotti s.r.l. in qualsiasi momento. Il prezzo effettivo dei Prodotti è
indicato nella conferma d’ordine di Donà Salotti s.r.l. e s’intende al netto di IVA. Even-
tuali variazioni / modifiche e/o sostituzioni dei Prodotti, concordate dalle parti dopo la
trasmissione della conferma d’ordine di Donà Salotti s.r.l., potranno comportare un
adeguamento del relativo prezzo in ragione di eventuali aumenti dei costi di produzione
e/o delle materie prime o delle ulteriori lavorazioni / sostituzioni eventualmente neces-
sarie. 5.2 Il prezzo dei Prodotti dovrà essere versato dal Cliente secondo le modalità e
alle scadenze indicate nella conferma d’ordine di Donà Salotti s.r.l., o altrimenti concor-
date dalle parti. 5.3 Qualora il Cliente richieda spedizioni di Prodotti con importo infe-
riore ad Euro 550,00 (al netto di IVA ed eventuali sconti), saranno addebitate le relative
spese di imballo e spedizione con un importo minimo di Euro 45,00. 5.4 Ove i tessuti lo
consentano, su richiesta scritta del Cliente, Donà Salotti s.r.l. potrà eseguire il prela-
vaggio del tessuto al costo di Euro 15,00 al metro lineare. Il Cliente è consapevole che
il prelavaggio potrà rendere il tessuto più elastico e morbido e che i tessuti in fibra na-
turale potranno subire una leggera perdita di tonalità. 5.5 Donà Salotti s.r.l. avrà facoltà
di sospendere la consegna dei Prodotti qualora: (a) le condizioni patrimoniali e/o finan-
ziarie del Cliente siano tali da mettere in pericolo il relativo pagamento; (b) il Cliente
non provveda al puntuale pagamento di Prodotti forniti da Donà Salotti s.r.l. in prece-
denza, anche nell’ambito di altri Contratti, sino all’integrale pagamento delle somme in
sofferenza e/o alla prestazione da parte del Cliente di idonee garanzie per le consegne
in corso, fermo in ogni caso il diritto di Donà Salotti s.r.l. al risarcimento di eventuali
danni. 5.6 In nessun caso, eventuali vizi e/o difetti dei Prodotti, quand’anche espressa-
mente riconosciuti da Donà Salotti s.r.l., nonché eventuali ritardi rispetto alle date di
consegna convenute, conferiranno al Cliente la facoltà di sospendere i relativi paga-
menti, e/o qualsiasi altro pagamento dovuto a Donà Salotti s.r.l. anche in forza di altri
rapporti contrattuali. 5.7 In caso di ritardo nei pagamenti, Donà Salotti s.r.l. avrà diritto
al pagamento degli interessi di mora sulla somma non pagata al tasso previsto dalla
legge. 6. RISERVA DI PROPRIETÀ’ Donà Salotti s.r.l. rimarrà la sola proprieta-
ria dei Prodotti sino alla data del loro totale pagamento. In caso di risoluzione del
Contratto per inadempimento del Cliente, eventuali pagamenti da quest’ultimo antici-
pati saranno trattenuti da Donà Salotti s.r.l. a titolo d’indennizzo nei limiti stabiliti dalla
legge, salvo il diritto di quest’ultima al risarcimento di ulteriori danni e al ritiro del Pro-
dotto a spese del Cliente. 7. GARANZIA 7.1 Donà Salotti s.r.l. garantisce che i
Prodotti rispettano gli standard di qualità indicati dalle norme italiane e ed europee e
che i Prodotti saranno esenti da vizi e difetti nella lavorazione e nei materiali per un
periodo di 24 mesi dalla data di consegna dei Prodotti (“Periodo di Garanzia”). 7.2
Qualora eventuali reclami sollevati dal Cliente durante il Periodo di Garanzia siano
fondati e accettati da Donà Salotti s.r.l., quest’ultima provvede a riparare la parte difet-
tosa del Prodotto, con consegna Ex Works (EXW - Incoterms 2020). Gli obblighi di
garanzia saranno efficaci e vincolanti solo ove a Donà Salotti s.r.l. sia data la possibili-
tà di verificare la sussistenza dei vizi e/o difetti contestati dal Cliente. L’obbligazione di
garanzia a carico di Donà Salotti s.r.l. s’intende integralmente adempiuta con l’elimina-
zione del difetto contestato dal Cliente, senza altri oneri od obblighi a carico di Donà
Salotti s.r.l.. 7.3 A pena di decadenza dalla garanzia, il Cliente dovrà denunziare per
iscritto, a mezzo raccomandata a.r., eventuali difetti riscontrati nei Prodotti consegnati
entro e non oltre 8 (otto) giorni dalla data di effettiva consegna o, trattandosi di difetti
occulti, entro e non oltre 8 (otto) giorni dalla scoperta degli stessi. 7.4 La garanzia è
esclusa qualora i difetti dei Prodotti siano stati causati e/o derivino dalle seguente
cause: (i) deposito e/o stoccaggio dei Prodotti in maniera non conforme alle istruzioni
di Donà Salotti s.r.l.; (ii) mancata osservanza delle regole e indicazioni contenute nelle
schede annesse al campionario e nel certificato di garanzia (e.g. lavaggio e manuten-
zione dei rivestimenti non conformi alle indicazioni fornite da Donà Salotti s.r.l., ecc.);
(iii) alterazioni e/o modifiche dei Prodotti non autorizzate per iscritto da Donà Salotti
s.r.l.(e.g. asportazione di parti imbottite, di gomma e piuma, ricucitura di cuscini, ecc.);
(iv) normale usura dei Prodotti; (v) errato montaggio dei Prodotti; (vi) tessuti o pelli
forniti dal Cliente o da fornitori incaricati da quest’ultimo; (vii) qualsiasi altra causa non
imputabile a Donà Salotti s.r.l.. Il Cliente in ogni caso decade dalla garanzia qui previ-
sta qualora non provveda regolarmente al pagamento del prezzo concordato, anche
nel caso in cui l’inadempimento o il ritardo riguardi solo parte del prezzo complessivo
dei Prodotti. 7.5 Ferma restando l’applicazione delle norme in materia di responsabilità
per danno da prodotti difettosi, e l’eventuale responsabilità in caso di dolo o colpa
grave, Donà Salotti s.r.l. non sarà responsabile per i danni diretti, indiretti o incidentali
che il Cliente e/o terzi dovessero subire a causa di difetti dei Prodotti. Il Cliente non
avrà titolo per risolvere il Contratto per difetti relativi a Prodotti coperti della presente
garanzia, in caso di puntuale adempimento da parte di Donà Salotti s.r.l. ai relativi ob-
blighi. 7.6 I Prodotti – in considerazione delle caratteristiche tipiche dei prodotti imbot-
titi – potranno avere dimensioni variabili di +/- 2 cm rispetto alle dimensioni indicate nel
catalogo o listino. Eventuali differenze di dimensioni nei limiti delle suindicate tolleran-
