Esperia reserves the right to apply possible variations for the improvement of products.
Approval: received orders become binding only after our express written confirmation.
Consignment: the consignment of the goods is considered to have been effected at the moment of the shipment from our
warehouses. The agreements with the shippers are always made in the name and on behalf of the client, who from this
point forward acknowledges the completed status of the consignment.
The merchandise is shipped on behalf of the customer, and at the customer’s risk.
Terms of consignment: approximately 30 days after order confirmation. The terms are indicative in nature; the seller
is in no way liable or subject to claims for compensation or payment of damages in the event of delays in consignment,
interruptions, partial or total suspensions of supply and shipment.
Claims: differences of hue cannot be considered as valid evidence for claims of defective materials. Any complaints
regarding quality or type of materials must be communicated no later than 8 days after the date of delivery. Customers
must make the items subject to complaints available for inspection to verify the described defects. In any case, the
installation of the products exempts our company from any further responsibility.
Any discrepancies or defects in quality of the goods, when indicated in keeping with legal terms and accepted or
acknowledged by the company, will be compensated only by replacement of the defective materials, following restitution
of the defective merchandise.
The company is not liable for any claims of compensation for damages.
Measurements and colors: some of the materials we utilize are classified as natural products crafted by hand, and as such
they may be subject to differences between the stated measurements and the measurements of the items effectively
supplied. The company is not liable for any claims for compensation in this regard on the part of the customer.
Packing and quantities: the good condition of the packing and packaging, as well as the quantity of the goods consigned,
is ratified by the acceptance of the goods on the part of the shipper. By signing the Transport Document, the shipper
assumes responsibility for the proper condition of the goods and their quantities. Packing in wooden crates will be
charged in the invoice.
Returns: customers cannot request replacement of goods for any reason without our express written authorization, and
all the expenses involved will be covered by the customer.
Cancelations: no cancelation of orders will be accepted if the goods have already been produced or if the manufacturing
has been initiated, or if the shipment has already been carried out.
In any case, order cancelation implies the obligation on the part of the customer to pay for the entire order. If acceptance of
the cancelation is feasible, the customer is compulsorily required to reimburse all expenses incurred by the manufacturer
prior to that moment.
Prices: the prices indicated in our listings do not include IVA (value-added tax), and cover consignment of the goods for
shipment at our facilities in Poggibonsi.
Payments: Payments must be made in legal tender to our headquarters in Poggibonsi or by bank transfer as per our
payment order, as agreed with the customer. A delay of over 10 (ten) days in payment, or lack of funds to cover a check or
money order, constitutes payment default. In this case we reserve the right to suspend supply and to cancel any existing
obligation on our part, demanding complete payment of our credit and taking legal action to obtain it, as well as payment
of damages. In any case, when 10 days have passed without receipt of the required payment, we are thereby authorized
to issue a sight draft with expenses, without preliminary notice. Furthermore, the unpaid debt will be subject to default
interest calculated at the current standard rate.
