CONDITIONS
GENERAL SALE CONDITIONS
DELIVERY TERMS :
The goods are meant Ex-Factory Borgomanero, tax exclu-
ded.
ORDERS :
The acceptance of the order will be always submitted to the
approval of the Seller, who can give written confirmation to
the Buyer.
DELIVERIES :
Both deliveries asked to the Seller and those proposed by
the same will be considered indicatives, acts of God excep-
ted. The missed delivery does not give the right to the
Buyer to cancel the order or make a complaint. Goods can
also be delivered partially.
PRICES :
Prices may be subjected to variations, and they become
mandatory only when agreed.
PACKAGING :
The packaging of our products is the one considered the
most proper and we will not accept it by return. The pa-
cking is generally included in the price. Special or unforese-
en packing shall be invoiced separately. They are made by
specialized people with habitual systems, according with
the good quality, but without any responsibility from us.
SHIPMENT :
The goods are transported at Buyer’s risk, also when they
are sold free delivered and the Seller cannot be held respon-
sible for any damages, directly or indirectly caused by the
Forwarder. Every claim must be directed to the Forwarder
by the Buyer. Possible signatures put by the Seller on the
warranty bulletins, asked for the transport of some goods,
are intended as executed by the Buyer and do not implicate
any responsibility by the Seller.
PAYMENTS :
Every delay on agreed payments, gives the right to the
Seller to debt to the Buyer the costs caused by his unful-
fillment. It is faculty of the Seller stopping the deliveries
and deleting the orders made by unfulfilling Buyers. Every
claim does not give the right to the Buyer to postpone the
payment.
CLAIMS :
All our products are scrupulously tested. In case of errors
or defects of production, the Buyer must present a claim
sending it by registered letter within 10 days from the re-
ceipt of the goods. The Seller cannot be held responsible
for any manumissions or wrong usages of the supplied
products. It will be the Buyer’s task examining the causes
of the claim before replacing to the Seller the defective
items. In case the defects will be confirmed by the Seller,
the Seller will change the items free delivered. Every deli-
very containing defective goods with carriage forward will
not be accepted.
RETURNED :
Returns are not accepted, if not previously authorized.
BROCHURES :
Pictures and technical drawings of our products, brochu-
res and catalogues, represent the single items and do not
involve a commitment of faithful execution. Weights and
measures must be considered only as indicative. The items
can be modified or delisted without any notice. Conse-
quently, we do not assume any responsibilities.
COURT :
Any controversy falls within the competence of the Novara
court.
The above-mentioned general sale terms will be considered entirely accepted by the buyer when he subscribes the or-
der or when the products are collected.
